Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Financial Stakes and a Will to Win

The owner disclosed operational insights of his racing venture, saying he invested $40 million of his personal wealth into the Cup Series operation launched with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Franchise System and Contract Pressure

At issue is the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with separately owned franchises, like the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for an hour and left the court to a media frenzy, with onlookers and reporters vying for a view or a picture of the global icon.

Leading the Legal Charge

23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a business model Jordan said is unlawful to maintain excessive control.

She recounted a hectic and tense period where the sanctioning body informed teams they had to sign a contract extension. The document spanned over a hundred pages outlining team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that 112-page package and take the issue to court. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar refused to engage, according to his testimony.

The Bottom Line: Victory

Ultimately, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he said, sharing that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I dove in.”

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the timing of the contract signing demand didn’t sit well.

According to her, the team founder first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.
